The Supreme Court today rejected the appeal of Vorn Pao, President of the Independent Democracy of Informal Economy Association (IDEA), and upheld his conviction on charges of “instigating intentional acts of violence with aggravating circumstances” under Articles 28 and 218 of the Criminal Code in relation to a 2014 strike action on Phnom Penh’s Veng Sreng Boulevard.

Pao was handed a suspended sentence of four years and six months in prison by the Phnom Penh Capital Court in 2014, which was upheld today by the Supreme Court. Pao spent more than four months in prison alongside 21 others in relation to these charges in 2014. He remains at risk of having the suspended sentence implemented if he is convicted on any charges in the next five years.

The Phnom Penh Appeal Court this morning dropped charges against Chea Chan, a unionist with the Cambodian Alliance of Trade Unions (CATU) who was arrested, charged and imprisoned in February 2024.

On 20 June 2024, the Kampong Speu Provincial Court convicted Chan of being an accomplice to theft contrary to Articles 29 and 356 of the Criminal Code. He was sentenced to one year in prison with six months of that time suspended. Chan was released from detention on 19 August ahead of today’s verdict, on account of the suspended portion of his sentence.

Chea Chantha, a local leader of the informal worker group Independent Democracy of Informal Economy Association (IDEA), was sent to pre-trial detention by the Svay Rieng Provincial Court on Friday evening after he was arrested on 16 July while talking to workers about accessing the National Social Security Fund (NSSF).

Chantha attended a workshop on Tuesday discussing climate change and social protections in Bavet, Svay Rieng. Later, he met with workers and was talking about the NSSF, a government social service, when police arrested him.

The Interior Ministry’s decision to investigate the Center for Alliance of Labor and Human Rights (CENTRAL) for a 4 June report the NGO issued about the Better Factories Cambodia programme is a clear reprisal and an attempt to intimidate an NGO that is committed to improving the freedom of association for all Cambodian workers and unions.

Koet Saray, President of the Khmer Student Intelligent League Association (KSILA), was denied bail by the Phnom Penh Appeal Court this morning and transferred back to Correctional Centre 1 (CC1) prison.

Over a dozen youth activists gathered outside of the court in support of Saray, who has been imprisoned since his arrest in April 2024 on charges of incitement in relation to ongoing land conflicts in Preah Vihear province.

Saray is also charged with “committing a misdemeanour after sentencing for a misdemeanour,” due to previously being convicted of incitement in 2021 over a peaceful gathering calling for the release of then-imprisoned union leader Rong Chhun. This additional charge potentially doubles the sentence of the new incitement charge, meaning he faces up to four years in prison if convicted.

Union leader Chea Chan was convicted today and sentenced to one year in prison by the Kampong Speu Provincial Court over charges of​ being an accomplice to theft, which were filed shortly after Chan unanimously won a union vote at Wing Star Shoes factory. Six months of the one-year sentence were suspended.

Chan has been imprisoned since his arrest in February 2024, while the alleged theft had occurred years earlier. Around 40 workers and union members gathered inside and outside the court today to support Chan, a unionist with the Cambodian Alliance of Trade Unions (CATU). The union has called the charges judicial abuse to stifle freedom of association, and Chan reported receiving threats warning him against forming a union at the factory prior to the union vote.

Chan is one of at least three union leaders imprisoned in Cambodia. Chhim Sithar, president of the Labor Rights Supported Union of Khmer Employees of NagaWorld (LRSU), has been imprisoned since November 2022. Morm Rithy, president of the Cambodian Tourism and Service Workers’ Federation, was jailed in May this year prior to an internal union vote.

We, a civil society group comprising unions, union federations, associations, and non-governmental organizations committed to promoting human and labor rights in Cambodia, deeply regret the illegal dismissal of Mrs. Roeurn Kolab by Shengbo Garment (Cambodia) Co., Ltd on June 30, 2023. It has been a year since she faced this injustice. The dismissal of Mrs. Kolab, a newly elected union leader, is a severe violation of the right to freedom of association and union organizing, fundamental to protecting workers’ rights in the workplace.

Around 30 workers gathered outside the Kampong Speu Provincial Court this morning to hold banners and call for the immediate release of Chea Chan, a union leader with the Cambodian Alliance of Trade Unions (CATU) who has been imprisoned since February 2024.

Chan faces between 3 and 10 years in prison on charges of theft with aggravating circumstances, charges that the union has said are judicial abuse intended to stifle freedom of association. Chan served as the president of the union at Wing Star Shoes factory, and was unanimously voted to be the factory’s union president shortly before his arrest. He had reported receiving threats prior to the vote warning him against forming a union in the factory.

Chan is one of at least three imprisoned unionists in Cambodia. Chhim Sithar, president of the Labor Rights Supported Union of Khmer Employees of NagaWorld (LRSU), has been imprisoned since November 2022. Morm Rithy, president of the Cambodian Tourism and Service Workers’ Federation, was jailed earlier this month prior to an internal union vote.

We, the undersigned civil society groups, unions and confederations, are dismayed by the Supreme Court’s unjust decision last week to uphold convictions against current and former members of the Labor Rights Supported Union of Khmer Employees of NagaWorld (LRSU). Authorities and courts have repeatedly failed to provide justice to LRSU activists. They must release union president Chhim Sithar from prison immediately and restore the freedoms of all defendants in this case.

On the morning of 3 May, the Supreme Court upheld convictions against eight current and former LRSU members, who were previously sentenced by the Phnom Penh Capital Court to prison sentences ranging from one to two years. Of the eight defendants, LRSU President Chhim Sithar is in prison serving a two-year sentence, and five other defendants are at risk of being immediately imprisoned. The five defendants — Chhim Sokhorn, Hay Sopheap, Kleang Soben, Sun Srey Pich and Touch Sereymeas — were sentenced by the Phnom Penh Capital Court to 18 months in prison.

The Supreme Court this morning upheld the convictions of current and former casino union members, prolonging the incarceration of LRSU President Chhim Sithar.

The four-judge panel delivered its verdict the morning of 3 May upholding convictions for eight defendants. Their sentences range from two years to one year in prison, with Sithar being the only defendant currently serving her two-year sentence.

While Sithar is expected to be released later this year once she completes her sentence, today’s verdict puts five of the defendants at risk of immediate imprisonment. The five defendants — Chhim Sokhorn, Hay Sopheap, Kleang Soben, Sun Srey Pich, and Touch Sereymeas — were given 18-month prison sentences by the Phnom Penh Capital Court.

Federations, unions, workers and civil society groups across Phnom Penh celebrated International Labour Day on Wednesday.

Events were held outside the Ministry of Labour and Vocational Training, near Wat Phnom and the National Assembly in Phnom Penh.

Union leaders and workers spoke about the progress they have made in the labour movement but warned against the criminalisation of unions, persecution of labour activists, and the recent regression in the workers' rights, their right to advocate for their peers and fair wages and work conditions.

To mark International Labour Day 2024, LICADHO, partner civil society groups and unions are releasing a video to highlight the achievement and challenges faced by the workers’ rights movement in Cambodia, and to acknowledge the contributions and sacrifices of labour activists and unionists, such as Chea Vichea.

We stand together with Cambodian unions in the ongoing fight for justice and labour rights.

More than 100 people gathered nearby Phnom Penh’s Wat Langka pagoda this morning to demand justice for murdered union leader Chea Vichea. The former President of the Free Trade Union of the Workers of the Kingdom of Cambodia (FTUWKC) was shot and killed in broad daylight at a newspaper stall outside the pagoda on 22 January 2004.

Today, 20 years later, participants including activists, youth and other civil society representatives gathered to call for the murderers to be brought to justice. Vichea’s younger brother and now National Power Party (NPP) Vice President Chea Mony and other FTUWKC representatives read statements about the unionist’s murder. Participants also submitted a petition to Prime Minister Hun Manet’s Cabinet, calling for justice for Vichea and other murdered activists.

Around 50 people from grassroots groups and unions this morning gathered in front of Correctional Center 2 (CC2) prison to call for the release of Chhim Sithar, President of the Labor Rights Supported Union of Khmer Employees of NagaWorld (LRSU).

Participants included supporters from the LRSU, Cambodian Alliance of Trade Unions (CATU); Cambodian Food and Service Workers’ Federation (CFSWF); Independent Democracy of Informal Economy Association (IDEA); Cambodia Tourism Workers' Union Federation (CTWUF); Cambodian Informal Economic Workers Association (CIWA); and Cambodian Youth Network (CYN); and LICADHO. Many joined with banners, balloons, and loudspeakers. They were monitored by approximately 10 plainclothes authorities, who photographed and videoed participants throughout.

Debt bondage and child labour plague Cambodia’s brick factories, as decades of inaction by the Cambodian government and construction and real estate sectors have allowed these human rights abuses to continue unchecked.

Today, on World Children’s Day 2023, the Cambodian League for the Promotion and Defense of Human Rights (LICADHO) is renewing its call for all actors to immediately end these shameful practices. “Bound by Bricks: An Opportunity to End Debt Bondage and Child Labour in Cambodia’s Brick Factories" is a report based on information documented by LICADHO from 21 brick factories across Kandal province and the capital Phnom Penh.

International brands’ garment waste is contributing to human rights and environmental harms in Cambodia’s brick factories. During visits to brick factories from April to September 2023, LICADHO found pre-consumer garment waste this year at five operational and two permanently closed brick factories. These factories in Phnom Penh and Kandal province burnt pre-consumer garment waste to fuel brick kilns. LICADHO found waste marked with 19 international brands as evidenced by the photographs below.

The Phnom Penh Appeal Court today upheld the convictions of eight current and former unionists from the Labor Rights Supported Union of Khmer Employees of NagaWorld (LRSU).

Nine activists, including union President Chhim Sithar, were convicted of incitement under Articles 494 and 495 of the Criminal Code by the Phnom Penh Municipal Court in May 2023. Eight of the activists appealed the verdict. They included Sithar, who received the maximum sentence of two years in prison; Chhim Sokhorn, Hay Sopheap, Kleang Soben, Sun Srey Pich and Touch Sereymeas, who were sentenced to 18 months in prison; and Sok Narith and Ry Sovandy, who received one-year suspended sentences.

The Appeal Court trial started this morning. The court announced its verdict upholding the lower court’s judgment in full this afternoon after deliberating for 30 minutes. Sok Kongkea, who was also convicted by the Phnom Penh Municipal Court and received a suspended sentence, did not appeal the lower court’s verdict.

More than 100 people from unions and organisations including the Cambodian Independent Teachers Association (CITA) today gathered at Freedom Park in Phnom Penh to celebrate World Teachers’ Day. The event was monitored by around 20 uniformed and plainclothes authorities, who prevented participants from marching. Participants instead remained at Freedom Park, and a representative from the Ministry of Education, Youth and Sport received their petition.

Many attendees held banners calling for the elimination of corruption in Cambodia’s education system, freedom of association for teachers, and an increase of teachers’ salaries and benefits. Other signs called for the release of prisoners such as the Labor Rights Supported Union of Khmer Employees of NagaWorld (LRSU) President Chhim Sithar and prominent activist Seng Theary.

Participants included representatives from CITA, LRSU, the Cambodian Labour Confederation (CLC) and other activists. Eight speakers delivered speeches including Ouk Chhayavy, President of CITA; Rong Chhun, President of the Cambodian Confederation of Unions (CCU) and Vice-President of the Candlelight Party; Long Rim, CITA board member; Ath Thun, President of CLC; Mom Sovandin, LRSU member; Thon Chantha, Candlelight Party youth leader; Heng Choeurn, President of the Cambodian Agricultural Workers Federation (CAWF) and CLC member; and political activist Prum Chantha.

The Phnom Penh Appeal Court today announced its verdict upholding criminal charges against four out of 10 people who were arrested in front of Phnom Penh's Yak Jin garment factory on 2 January 2014, one day before the violence that took place along Veng Sreng Boulevard in January 2014. The strike was notoriously shut down on 3 January 2014 when mixed government forces opened fire on the striking workers.

The 10 workers were convicted by the Phnom Penh Municipal Court in 2014 of instigating intentional acts of violence with aggravating circumstances, contrary to Articles 28 and 218 of the Criminal Code. Out of the 10 defendants, only four (Chan Puthisak, a Boeung Kak Lake land activist; Theng Savoeun, President of the Coalition of Cambodian Farmer Community (CCFC); Sokun Sambath Piseth, a former staff member at Center for Labor Rights of Cambodia; and Vorn Pao, President of the Independent Democracy of Informal Economy Association (IDEA)) appealed their sentences.

The Appeal Court upheld the Municipal Court’s decision to sentence Theng Savoeun to four years’ imprisonment, as well as its sentences of four years and six months for Chan Puthisak, Sokun Sambath Piseth, and Vorn Pao, all of which were suspended by the lower court. All four had already spent between 3 January and 30 May 2014 in prison. The Appeal Court also dropped the 8 million riel fine (around US $2,000) imposed by the lower court on all four defendants.

Around 2,000 people celebrated International Labour Day 2023 at two key events in Phnom Penh this morning. Workers, unionists, and civil society gathered at Wat Phnom and outside the National Assembly to call for respect for labour rights and an end to harassment of unionists.

Garment workers, construction workers, informal workers, farmers, entertainment workers, domestic workers, hospitality workers, and others gathered this morning. Unionists and workers marched from Wat Phnom to the Council for the Development of Cambodia, where they gave speeches, sang songs, and shared ideas in a public forum. Another group marched from the National Assembly to Chea Vichea's statue, where they gathered to hear speeches.
